Lumsden Stuart Ltd is an industrial merchant trading through the internet as Power Tools UK a registered trade name, Power Tools UK (the seller) offer professional goods and services to you and your company (the customer). Power Tools UK reserves the right to alter the terms and conditions or working practice without notice with changes being applied to orders received from the date of any change. Power Tools UK is an industrial supply company offering high quality power tools and accessories to the customer and will for the purposes of business through Power Tools UK supply all goods and services using UK industrial terms and conditions.

2. Order Processing

Ordering and dealing with Power Tools UK in all aspects of business is a simple and easy process, just choose one of the various methods listed below and leave the rest to Power Tools UK one of the country's leading professional power tool suppliers.

3. Power Tools UK Website

The website at powertoolsuk.co.uk is the quickest and most efficient way to place business with Power Tools UK open for business 24 hours a day 365 days a year. When ordering goods through the website an automatically generated reply will be e-mailed back to your mailbox confirming receipt of your request to order, the contract to supply is formed only when the Power Tools UK has received, reviewed and accepted your request to order. Power Tools UK reserve the right to cancel any request to place any order by the customer, at any time and for any reason, with a full and complete refund being generated back through to the source account within 7 working days. Please refer further to Conditions of Website Trading & Pricing Policy for further detail regarding offshore orders and delivery.

You may also choose to place business using our Technical Help Lines on 01355 234328, we are open Monday to Friday 8.30am through to 5.00pm, call us during these times with your requirements and a member of our knowledgeable sales team will quickly deal with your request, check stock or answer any specific technical questions you may have relating to any power tool or accessory in our extensive tools range.

5. Post and Faxed Orders

Mail or faxed orders can be dealt with providing the customer supplies full details of the goods required including payment and a daytime contact telephone number. The supplier can only accept cheques made payable in Pounds Sterling drawn on recognised UK bank. From date of banking by Power Tools UK please allow seven to ten working days for payment to clear. Please check all payments should the cheque and/or the amount be incorrect, the order and payment will be returned to the customer for correction before it can accepted and processed for dispatch to the customers designated delivery address.

6. Pricing Structures & Payments

Prices for any power tool or accessory on Power Tools UK is the price the supplier initially offers the customer the goods at, and is subject to additional carriage charges and V.A.T. at standard rate. Exceptions to this standard working practice may occur due to the following circumstances: every effort is made by the supplier to offer the best possible and correct price at all times on the website, however even with the best intentions errors may occur from time to time. Should this unfortunate situation arise at the review stage of any customer order request, the customer will be contacted at the earliest opportunity and given the choice to cancel the original order request or proceed at the corrected price. Should the supplier, Power Tools UK, be unable to raise the customer to discuss this matter or receive no decision regarding price the order will be deemed to be cancelled 5 working days following date of order, with a full and complete refund being made within 7 working days of cancellation. Initiating an order request through our industrial website authorises Power Tools UK to debit the customer’s credit or debit card for the total amount shown, full payment includes carriage and tax at the current rate where appropriate, the total value for payment must be confirmed before any customer order request can be accepted for shipping.

7. Processing Customer Orders

Handling customer orders: orders received up to 1.30 p.m. (Monday to Friday, excluding bank holidays), will be dispatched same day (Subject to stock availability and payment clearance). Orders taken over the weekend will be dispatched on the first working day following any weekend or bank holidays. Power Tools UK will endeavor to dispatch orders for out of stock items within 3 to 5 working days from order date. Should there be any delay Power Tools UK will contact the customer with as accurate a delivery as possible, this will allow the customer to re-schedule delivery or cancel and receive a full refund.

8. Dispatch and Delivery of Orders

Power Tools UK use several methods for delivery of orders getting tools safely to our customer at the earliest opportunity. Royal Mail for small lightweight and low value products and several road transport logistics companies for all other tools and products. We are able to offer our customers the option to upgrade to a next day road service, this service is at extra cost and can only be actioned through our Technical Help Line for tools in stock at the time an order is placed.

Royal Mail service is the preferred method of dispatch for orders with a goods value  of £20.00 or under, this service normally takes a couple of days using first class post however Power Tools UK cannot 100% guarantee delivery within this time due to certain circumstances out of our control, time of year, weather etc. All other warehouse stock orders are dispatched within one full working day using road transport completing the delivery in 3 working days or sooner (UK mainland only); offshore service to islands around the UK is available including R.O.I. at extra cost. Power Tools UK is unable to dispatch goods with an overall length greater than 1.5mtr to the Highlands and Islands, Northern Ireland, Isle of Man and the Channel Islands. Road transport deliveries must be signed for on delivery no shipments are left without a signature, should the delivery not be possible at the customers designated delivery address, a card normally with local post office details will be left by Parcelforce informing the customer that by visiting the local post office the customer can uplift their order from the post office by presenting the delivery card with the relevant consignment shipping number; proof of personal identification will be required for a post office uplift. Following an unsuccessful delivery the goods will be held at the local post office for up to 14 days awaiting collection by the customer, no further deliveries will be attempted by the logistics company on behalf of the supplier; failure to uplift by the customer will result on the goods being returned to the supplier.

The delivery charge shown on the customer invoice is only a contribution to the cost of shipping & packing, as stated road transport delivery requires a signature for receipt of the goods, the customer has the choice to provide Power Tools UK with a billing/delivery address or an alternative third party business address, no third party private addresses, where a stated contact should be in a position to sign for the delivery of the order. The customer should make all necessary arrangements to take delivery of any trade shipment from the supplier, as this website is classed as a professional trade site, company trading conditions apply to all orders therefore no carriage charges will be refunded should the goods remain undelivered, following all steps being taken by the supplier to deliver successfully to the customers instructions. The risk for the goods supplied to the customer from the supplier passes to the customer in that the customer is responsible for loss, damage or deterioration of the goods from the time the customer signs off for delivery being received in good transit condition.

Delivery charges on any invoice is only a contribution to the actual cost of packing and shipping, road transport deliveries require a signature on delivery, the customer has the choice to provide Power Tools UK with a third party business address where a stated contact should be in a position to sign for the delivery of your order. Customers must make all necessary arrangements for delivery of any shipment; no carriage charge will be refunded should the goods remain undelivered, following all steps being taken by the supplier to deliver. The risk for the goods supplied by Power Tools UK passes to the customer in that the customer is responsible for loss, damage or deterioration of the goods from the time and date of the signature for the delivery.

9. Warranty

Power Tools UK only supply first generation tools UK sourced with full UK warranties and European CE kite marks. During the warranty period should any manufacturing or material fault occur, the power tool or related accessory will be repaired at official UK manufacturer’s repair station, or at the discretion of Power Tools UK may be replaced during the warranty period. Should for any reason a machine require attention the original invoice must be presented as proof of purchase, should this not be presented to a repair station the supplier cannot be held responsible for warranty work being refused, and a charge made for the repair. Please note most importantly that the warranty for power tools does not cover accidental damage, misuse and or abuse of the machine or fair wear and tear and the granting of any warranty repair is at the discretion of the repair station.

10. Cancellation of an Order

As a customer you have the legal right to cancel any accepted order placed through Power Tools UK up to 14 days from the day after the date the goods were delivered. If you wish to cancel your order before it is dispatched please notify us by e-mail or through our Technical Help Line on 01355 234328 at the earliest opportunity, a full and complete refund for orders cancelled before dispatch will be issued within 14 days. Should the goods already have left our warehouse and in transit to the delivery address Power Tools UK will be unable to stop the shipment. Do not unpack the goods by removing the protective wrap, return the shipment to the supplier within 14 days using a suitable traceable method of transit, this is at the customers cost. Should you already have the goods from Power Tools UK and wish to return them, please re-pack the goods in a suitable protective wrap and return within 14 days of receipt, again using a suitable method of traceable shipment at your cost. Refund to the original source for cancellation of the customer order will be for the value of the goods only, excluding carriage to and from the customer, and will only be given for tools and accessories returned on the exact resalable condition as originally shipped, new and unused as originally sold, no refund will be issued for sub standard goods being returned and will be quarantined awaiting the customer uplifting his property.

11. Returning Goods: Damaged on Receipt, Faulty/Non Start or Incorrectly Delivered

Should any tool or piece of equipment from Powertools UK arrive damaged or fail to start, you must contact the supplier within thirty working days through our technical helpline 01355 234328, before returning the goods. Please state your order number, the name you ordered the goods under, and reason for contacting the supplier, please follow the instructions given by one of the Technical Team, we will quickly and effectively replace (subject to availability) or refund the purchase. Goods returned to the supplier will be fully inspected to confirm the reported fault/damage originally reported, should the returned machine be found not to be faulty as originally reported, the customer may incur the cost of the return carriage charge. All goods must be returned with care and attention being paid to adequately protecting the goods for return transit to us, failure to protect the goods for return will affect what we can do to correct the original problem, Power Tools UK reserves the right to deduct a charge for transit damage due to a lack of care in packaging by the customer

12. Returning Goods Incorrectly Ordered

Following delivery of your order should you find that you have ordered the wrong item, please contact our Technical Help Line on 01355 234328 within thirty working days and clearly explain your error, please follow the clear instructions given to you by one of our team. Please make sure that when returning goods for exchange a traceable method of transit is used, Power Tools UK cannot be held responsible or accept liability until the goods are safely received and signed for by one of our staff. Replacement machines will incur a carriage charge to dispatch plus any additional adjustment in cost should the replacement differ in price from the customers original order, we regret that the supplier cannot refund any costs which the customer has incurred in returning the initial item to the Power Tools UK warehouse. Where a refund is requested without replacement (excluding where requested within 14 days, as per paragraph 10. Cancellation of an Order) Power Tools UK reserve the right to charge a restocking fee of up to 15% for any machine returned, no refunds will be given should the goods be returned and on inspection found to be in an inferior condition and not resalable. Credit payments back through to customer credit card accounts will be processed and completed within 14 working days of the goods being safely returned and signed for.

13. Privacy Policy & Complaints

Power Tools UK is fully committed to protecting your privacy and only uses the information collected about the customer lawfully (in accordance with the Data Protection Act 1998). Information will only be used to process the customer order and to continue to provide a high quality service. The supplier will never pass information to a 3rd party. The level of service and experience in servicing the UK power tool market allows the supplier to be confident enough to think that the customer should be pleased with the products and services every time they are purchase, however, should the customer at anytime feel that they would like to make a complaint, or comment regarding any aspect of the service, please contact via post, email [email protected] or fax 01355 266299, please mark for the attention of Mr Lumsden Stuart, Managing Director, any contact regarding comments and or complaints the supplier receives will be dealt with the urgency demanded, Power Tools UK endeavor to respond in full within five working days.

14. Conditions of Website Trading and Pricing Policy

Automatic trading on our website at powertoolsuk.co.uk has been designed for customers with a UK mainland address, Power Tools UK is able to assist customers who reside "offshore" or outside the UK by contacting our Technical Help Lines on 01355 234328. Corrected carriage costs will be quoted for shipping to the customers designated delivery address, alternatively please visit our sister company at powertoolsuk.co.uk where offshore carriage has been calculated and can be dealt with automatically. All prices shown are subject to change at any time and are shown as a guide for the warehouse stock only, prices cannot be held on order requests placed once initial warehouse stocks have been exhausted. All pictures and technical descriptions are for guidance only, full specifications must be double checked on the manufacturer's websites or published literature as power tool versions can change from manufacturers at anytime.

15. Invalidity

Should any part of Power Tools UK terms and conditions be unenforceable, invalid or illegal, legality or enforceability of all other heading and clauses of our terms shall remain unaffected and in full force and effect at all times

16. General Agreement Terms

Disputes in connection with agreement contracts through Power Tools UK will be heard in the courts of Scotland as the Laws of Scotland apply to this agreement and terms and conditions.

Customers agree and confirm through the purchase of power tools and accessories from the supplier Powertools UK, to use the machines for their normal and proper use as intended by the manufacturer. The customer agrees to read, study and follow the manufacturer’s instructions supplied with any power tool or related product purchased before attempting to use any tools or accessories
