1. Contract

Lumsden Stuart Ltd (Company Registration Number SC132949) is an established industrial merchant trading on the internet as Power Tools UK (the seller) offers professional goods and service to you and your company (the customer).
Power Tools UK offer high quality power tools, accessories and related products to customers and for the purpose of business supply goods and services using UK industrial Terms and Conditions.
The seller reserves the right to alter or change Terms and Conditions with changes applying to all orders recieved from the date of any change.

2. Order Processing

Ordering and dealing with Power Tools UK in all aspects of business is a simple and easy process, just choose one of the various methods listed below and leave the rest to Power Tools UK one of the country's leading professional power tool suppliers.

3. Power Tools UK Website

The Power Tools UK website www.powertoolsuk.co.uk is the quickest way to place business with Power Tools UK open for business 24 hours a day 365 days a year, we are unable to accept telephone orders at this time.
When ordering power tools, accessories or related products an automatically generated reply will be e-mailed to the customer confirming reciept of the customer order. The contract to supply is formed only when the seller has reviewed and accepted the customer order for processing
The seller reserves the right to cancel any request to place orders by the customer at any time and for any reason, a full and complete refund will be actioned back through the original payment source within 3 to 4 working days should this action be required.

4. Product Pricing and Payments

Product prices on the sellers website are up-dated constantly offered to customers exclusive of VAT at the current rate of 20%, exceptions may occur due to circumstances out of our control. Every effort is made to offer the best possible correct price on the website page, however even with the best of intentions a pricing error may occur from time to time.
Should this arise at the review stage of the order request, the seller will contact the customer at the earliest opportunity, explaining the situation giving the customer the opportunity to request a refund or proceed at the corrected cost.
If the seller is unable to raise the customer or recieve no decision in 5 working days from date of order, the order will be deemed to be cancelled and fully refunded back to the original payment source within 3 working days.       
Initiating an order request authorises the seller to debit the customer’s credit or debit card for the total amount shown, full payment includes tax at the current rate of 20% and carriage where appropriate for goods ordered under £100 nett.

5. Order Processing

Customer orders recieved Monday to Thursday by 2.30pm will be depatched by the seller same day subject to warehouse stock availability and payment clearance. Orders recieved late Friday, Saturday and Sunday will be dispatched on the first working day following the weekend of bank holiday again subject to warehouse stock availability and paymetn clearance. The seller will endevour to dispatch out-of-stocks within 3 working days from order date, should there be a further delay the customer will be contacted with as accurate a delivery schedule as possible allowing the customer to agree or request a full refund. 

6. Delivery Information

Power Tools UK use APC, DHL, Parcelforce and Tracked Royal Mail as main delivery partners, FREE SHIPPING for orders from £100 excluding VAT and £5.75 + VAT for order value up to £99.00

Power Tools UK service remote  and UK Islands, Highlands and Islands, Isle of Man, Isle of Wight and Northern Ireland. Restrictions in service due to maximum weight/overall length apply to certain postcodes.

7. Warranty

As official stocking agents for Milwaukee, DeWALT, Makita and Bosch Power Tools, during the initial 12 month warranty period, product failure due to a manufacturing fault will be organised by Power Tools UK and repaired at an official manufacturers repair station, and/or with guidance from the manufacturer replaced during the initial warranty period. 
A copy of the original purchase invoice must be presented with the machine before warranty work can progress, Power Tools UK cannot be responsible for warranty work being refused without proof of purchase.
Warranty for power tools does not cover accidental damage, misuse or abuse of a machine plus fair wear and tear including chucks, granting of a warrasnty repair is at the descretion of the manufasturers repair station.
     
 

8. Cancellation of an Order

As a customer you have the legal right to cancel any accepted order placed through Power Tools UK up to 14 days from the day after the date the goods were delivered. If you wish to cancel your order before it is dispatched please notify us by e-mail or through our Technical Help Line on 01355 234328 at the earliest opportunity, a full and complete refund for orders cancelled before dispatch will be issued within 14 days. Should the goods already have left our warehouse and in transit to the delivery address Power Tools UK will be unable to stop the shipment. Do not unpack the goods by removing the protective wrap, return the shipment to the supplier within 14 days using a suitable traceable method of transit, this is at the customers cost. Should you already have the goods from Power Tools UK and wish to return them, please re-pack the goods in a suitable protective wrap and return within 14 days of receipt, again using a suitable method of traceable shipment at your cost. Refund to the original source for cancellation of the customer order will be for the value of the goods only, excluding carriage to and from the customer, and will only be given for tools and accessories returned on the exact resalable condition as originally shipped, new and unused as originally sold, no refund will be issued for sub standard goods being returned and will be quarantined awaiting the customer uplifting his property.

9. Returning Goods: Damaged in Transit, No Start, Faulty or Incorrectly Delivery

Any product received in a damaged condition, refuses to start or develops a fault within the first few days, contact the Technical Help Line on 01355234328 or e-mail [email protected].
Supply the team with the relevent Power Tools UK order number generated when the order was placed on-line plus customer name on the order and the reason for contact. 
Assistance and guidance by one of the team may involve added instruction for a minor fault, photographs may be requested to assist further with any problems.
Our team will work quickly and efficiently to resolve all issues, this may involve pick -up of the machine and taken directly to the manufacturers repair centre for fast assessment of the reported problem.
The repair centre will proceed with a repair or possible replacement and quickly return directly to the customers designated delivery address.
Incorrect goods will be swiftly uplifted at suppliers cost and replaced with the correct product, should the customer for any reason wish a full refund, this will be actioned on return of the incorrect goods.      

10. Returning Goods Ordered in Error

If a customer finds they have ordered a product incorrectly, contact should be made with the seller through the Technical Help Line on 01355 234328 or by e-mail [email protected] within 30 days of purchase. Confirm the original Power Tools UK order number and name on the customer order.
The Technical Team will guide the customer through the swift returns procedure and efficiently resolve any problem quickly and efficiently through to refund. 
The seller requests that returned goods ordered in error by the customer must be in the new and unused condition as originally supplied, a request for a traceable method of transit to be used for safe return
Refund back to the original payment source will be finalised within 3 working days following signing off as suitable for resale. 

11. Privacy Policy & Complaints

Power Tools UK is fully committed to protecting your privacy and only uses the information collected about the customer lawfully (in accordance with the Data Protection Act 1998). Information will only be used to process the customer order and to continue to provide a high quality service. The supplier will never pass information to a 3rd party. The level of service and experience in servicing the UK power tool market allows the supplier to be confident enough to think that the customer should be pleased with the products and services every time they are purchase, however, should the customer at anytime feel that they would like to make a complaint, or comment regarding any aspect of the service, please contact via post, email [email protected] or fax 01355 266299, please mark for the attention of Mr Lumsden Stuart, Managing Director, any contact regarding comments and or complaints the supplier receives will be dealt with the urgency demanded, Power Tools UK endeavor to respond in full within five working days.

12. Conditions of Website Trading and Pricing Policy

Automatic trading on our website at powertoolsuk.co.uk has been designed for customers with a UK mainland address, Power Tools UK is able to assist customers who reside "offshore" or outside the UK by contacting our Technical Help Lines on 01355 234328. Corrected carriage costs will be quoted for shipping to the customers designated delivery address, alternatively please visit our sister company at powertoolsuk.co.uk where offshore carriage has been calculated and can be dealt with automatically. All prices shown are subject to change at any time and are shown as a guide for the warehouse stock only, prices cannot be held on order requests placed once initial warehouse stocks have been exhausted. All pictures and technical descriptions are for guidance only, full specifications must be double checked on the manufacturer's websites or published literature as power tool versions can change from manufacturers at anytime.

13. Invalidity

Should any part of Power Tools UK terms and conditions be unenforceable, invalid or illegal, legality or enforceability of all other heading and clauses of our terms shall remain unaffected and in full force and effect at all times

14. General Agreement Terms

Disputes in connection with agreement contracts through Power Tools UK will be heard in the courts of Scotland as the Laws of Scotland apply to this agreement and terms and conditions.

Customers agree and confirm through the purchase of power tools and accessories from the supplier Powertools UK, to use the machines for their normal and proper use as intended by the manufacturer. The customer agrees to read, study and follow the manufacturer’s instructions supplied with any power tool or related product purchased before attempting to use any tools or accessories
